Domestic Violence Services Regulations
- Parts 452-455 of 18 NYCRR establish standards for the operation of residential programs for victims of domestic violence.
- Part 462 of 18 NYCRR establishes the standards for non-residential services to victims of domestic violence.
- Part 408 of 18 NYCRR establishes per diem rates and social services district responsibility for financial and contractual arrangements with providers of residential services to victims of domestic violence.
Regulatory Process
OCFS confers with stakeholders
The regulation is drafted and supporting documentation is prepared which includes:
- Regulatory Impact Statement
- Regulatory Flexibility Analysis
- Rural area Flexibility Analysis
- Job Impact Statement
- Summary of the regulation, if the regulation is over 2,000 words
- Fiscal analysis is prepared by OCFS Budget and incorporated into supporting documentation
Regulatory Process
- Proposed regulation is submitted to the Governor’s Office of Regulatory Reform (GORR) for approval to proceed
- After approval, OCFS submits regulations and supporting documents to Department of State for publication in the State Register
Regulatory Process
- Once published, the public may submit comments (45 days)
- If the regulations are substantively changed after the public comment period they must be republished for comment (30 days)
- Final rule is adopted
Regulatory Process
- OCFS files text of adopted rule with the Department of State, including an Assessment of Public Comment
- OCFS replies by letter to those who commented, with how such comments were resolved
- Notice of Adoption is published in the State Register to provide public notice
- The complete official text is published in Book 18 New York Codes Rules and Regulations (NYCRR)
